1. Acceptance of Terms
By accessing or using MyProductPassport ("the Service"), operated by Passport Digital Limited (company number 17067449), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
MyProductPassport, a service of Passport Digital Limited, provides a platform for creating, managing, and publishing Digital Product Passports (DPPs) in compliance with EU ESPR regulations. The Service includes tools for product data management, QR code generation, GS1 Digital Link support, and compliance tracking.
MyProductPassport is a compliance assistance tool and does not constitute legal, regulatory, or certification advice. The Service helps you organise and present product data in formats aligned with EU Digital Product Passport requirements, but it does not certify, verify, or guarantee that your products or passports meet any specific regulatory standard. You are solely responsible for ensuring the accuracy of your data and your compliance with applicable laws and regulations.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Promptly update your information if it changes
- Accept responsibility for all activities that occur under your account
4. Subscription Plans and Payment
The Service is available under the following tiers:
- Free: Up to 5 products at no cost
- Starter: Up to 50 products
- Professional: Up to 500 products
Paid subscriptions are billed monthly through Stripe. You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.
5. Your Data and Content
You retain ownership of all product data and content you submit to the Service. By using the Service to publish Digital Product Passports, you grant us a licence to display that information publicly as required to operate the passport functionality.
You are solely responsible for ensuring the accuracy of product information, compliance data, and any claims made in your Digital Product Passports.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false or misleading product compliance information
- Attempt to gain unauthorised access to other users' data
- Interfere with or disrupt the Service infrastructure
- Reverse engineer or attempt to extract the source code of the Service
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
While we aim to provide accurate compliance tools, MyProductPassport does not guarantee that using our platform will ensure full regulatory compliance with ESPR, EU Digital Product Passport requirements, or any other regulation. Compliance scores, required field lists, and sector-specific guidance provided within the Service are for informational purposes only and should not be relied upon as legal or regulatory advice. You should seek independent legal and regulatory advice for your specific obligations.
8. Limitation of Liability
To the maximum extent permitted by law, Passport Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may delete your account at any time. Upon termination, your published Digital Product Passports may be taken offline.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
